§ 107-18. Variations and exceptions.

  • (a)

    Whenever the tract to be subdivided is of unusual size or shape or is surrounded by development of unusual conditions that the strict application of the requirements contained in this chapter would result in real difficulties or substantial hardship or injustice, the commission may vary or modify the requirements so that the subdivider may develop the property in a reasonable manner, but so that, at the same time the public welfare and interests of the city and surrounding area are protected and the general intent and spirit of this chapter is preserved.

    (b)

    Any regulations or provisions of this chapter may be changed or amended from time to time by the council; provided, however, that any changes or amendments shall not become effective until after study and report by the commission and until after a public hearing has been held, public notice of which shall have been given in a newspaper of general circulation, at least 30 days prior to the hearing.
