§ 107-17. Minimum improvements required.

  • (a)

    Improvement plans, profiles, and cross sections. The subdivider shall submit to the administrator the following plans, profiles and cross sections, drawn to a horizontal scale of one inch to 100 feet or less and a vertical scale of one to 20 feet or less, and specifications for the construction of the improvements for the subdivision as required in this chapter. All elevations shall be referred to mean sea level.

    (1)

    The plan and profiles of each street with tentative grades and street intersection elevations.

    (2)

    The cross sections of a proposed street showing the width of roadways, present and proposed grade lines, and location and size of utility mains. The cross sections shall be taken and platted at intervals of not more than 100 feet along the centerline unless otherwise required by the administrator, and shall extend out to the sides to that point where the proposed grade intersects the existing grade. In no case shall these cross sections be extended less than the full width of the right-of-way.

    (3)

    The plan and profile of proposed sanitary sewers and stormwater sewers with grades and pipe sizes indicated, and a plan of the proposed water distribution system showing pipe sizes and location of valves and fire hydrants.

    (4)

    Specifications for the required improvements. Standard specifications approved by the administrator may be used.

    (b)

    Improvements required.

    (1)

    The subdivider shall install and construct all improvements required by this section. All required improvements shall be installed and constructed in accordance with the specifications and under the supervision of the administrator and to the satisfaction of the council.

    (2)

    Underground installation of utilities required. All electrical, telephone, communication, street lighting, traffic signals, television wires and cables, and any other public utility or associated service providing service within any subdivision shall be installed entirely underground in accordance with the rules, regulations and specifications of the public utility or agency providing the service. The subdivider shall furnish information that satisfactory arrangements have been made with the serving public utility or agency.

    (3)

    The commission may recommend to the council, after obtaining approval from the serving public utility or agency, that underground requirements may be waived if topographical, soil or other conditions make the installation unreasonable.

    (4)

    For the purposes of this section, appurtenances and associated equipment such as, but not limited to, surface mounted transformers, concealed ducts, pedestal mounted terminal boxes and meter cabinets may be placed aboveground as the regulations and policy of the serving public utility provide.

    (5)

    Poles without overhead wires shall be permitted for street light poles, fire alarm boxes, traffic signals, civil defense alarms or other municipal equipment installed under the direction of the council.

    (6)

    All streets and public ways shall be graded to their full width, including side slopes, and to the appropriate grade as shown on the improvement plans or approved by the administrator. Where the streets serve lots having an area of less than 20,000 square feet, it shall be surfaced to a width of not less than 32 feet with one whose specifications meet the approval of the council. All of the construction shall be in accordance with standards and specifications approved by the administrator. Concrete curbs shall be installed along each side of the pavement.

    (7)

    Pedestrian walkways. Sidewalks with a minimum width of four feet and a minimum thickness of four inches of Portland concrete cement shall be installed; provided, however, that where the property is platted in lots having an area of at least 20,000 square feet and a width of at least 100 feet, the council may waive these requirements. The sidewalks shall be constructed to the grade approved by the council after receiving the report and recommendation of the administrator.

    (8)

    Street grading and surfacing.

    a.

    All streets shall be filled or excavated to the grade approved by the council after receiving the recommendation of the administrator, and the actual construction shall be subject to the supervision of the administrator. Portland cement concrete or asphalt concrete paving is required. Street grades and design strength of the surfacing shall be approved by the administrator.

    b.

    Streets shall be so arranged that grades shall, so far as practicable, not exceed five percent for major streets and ten percent for minor streets, and no grade shall be less than one-half percent.

    c.

    All alleys included in any plat or subdivision shall be brought to the grade approved by the council and utilities shall be installed therein or at the rear of platted lots if equally feasible with other methods of installation.

    d.

    All streets shall have curb and gutter, designed in accordance with commonly accepted engineering standards.

    (9)

    Water supply. Where a public water main is reasonably accessible, the subdivider shall continue with the water mains and provide a water connection for each lot in accordance with standards, procedure, and supervision of superintendent. Main sizes shall be determined by the superintendent. Water main connection shall be done to the instruction of the superintendent to fit into any looping or extension plan. A share of the total cost of water main extensions may be borne by the city. The exact amount borne shall be determined by negotiation with the subdivider with decision and approval of the council. The ownership of all mains, valves and hydrants will be with the city, and their use will be regulated by all resolutions pertaining thereto.

    (10)

    Sanitary sewers. The subdivider shall install a sanitary sewer collection system which shall be connected to an existing sanitary sewer line. The new system and connection shall be approved by the superintendent and the council. Cost may be borne proportionately as agreed upon between subdivider and council.

    (11)

    Storm drainage. All necessary improvements, including storm sewers, shall be made to provide for the adequate disposal of stormwater and to maintain any natural drainage course. All construction shall be in accordance with plans approved by the superintendent.

    (12)

    Monuments. Monuments shall be placed at block corners, point of curves, change in direction along lot lines and at each lot corner in accordance with city specifications; monuments at block corners shall be concrete posts with steel center rods. Lots shall be marked by three-fourths-inch diameter iron pins, 30 inches long.

    (13)

    Any provision in this chapter to the contrary notwithstanding, improvements required by this chapter may be deferred or waived by the council as follows:

    a.

    Subject to the terms and conditions as it may impose, the council may defer or waive any or all required improvements as in its judgment are not requisite in the interest of the public health, safety and general welfare or which are inappropriate because of inadequacy or lack of connecting facilities.

    b.

    Whenever it is deemed necessary by the council to defer the construction of any required improvements, the council may require the subdivider to pay to the city as a condition of the deferral, all or part of the estimated costs of the deferred improvements with the timing of the payment and the terms thereof to be in the discretion of the council. In lieu of a payment, and in its discretion, the council may require the delivery of a surety bond to ensure completion of the improvements in a form to be approved by the council.
