§ 109-25. Violation and penalties, and enforcement.

  • (a)

    Any person, firm or corporation who violates, disobeys, omits, neglects, or refuses to comply with or who resists the enforcement of any of the provisions of this chapter upon conviction shall be fined not more than $100.00 or imprisoned for not more than 30 days for each offense. Each day that a violation is permitted to exist constitutes a separate offense. Violation of this chapter is also a municipal infraction under article II of chapter 1. It shall be the duty of the administrator to enforce this chapter.

    (b)

    In case any building or structure is erected, constructed, reconstructed, altered, repaired, converted, or maintained, or any building, structure or land is used in violation of this chapter, the administrator, in addition to other remedies shall recommend the city institute any proper action or proceedings to prevent such unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance, or use to restrain, correct or abate such violation, to prevent the occupancy of the building, structure or land, or to prevent any illegal act, conduct business or use in or about the premises.
