§ 109-11. C-1 Central Business District.

  • The regulations set forth in this part shall apply in the C-1 Central Business District. The intent of the C-1 district is to provide for the grouping of the majority of business uses and services in the central business district and in defined secondary business centers.

    (1)

    Principal permitted uses.

    a.

    Any use permitted in the R-3 district, except single-family and two-family dwellings.

    b.

    Animal hospital, commercial (kennel), provided all phases of the business conducted upon the premises be within a building where noises and odors are not evident to adjacent properties.

    c.

    Antique shop

    d.

    Apparel shop.

    e.

    Bakery whose products are sold only at retail and only on the premises.

    f.

    Bicycle shop, sales or repair.

    g.

    Billiard parlor and pool hall.

    h.

    Book store.

    i.

    Bus and taxi depots.

    j.

    Candy shops where products are sold only at retail and only on the premises.

    k.

    Carpenter and cabinet shop.

    l.

    Carpet and floor covering store.

    (2)

    Accessory uses.

    a.

    Residential units when located above first floor level of the above principal permitted uses.

    b.

    The waiver of off-street parking requirements within the C-1 district does not apply to dwelling uses.

    c.

    Storage facilities related to the operation of the principal permitted use.

    d.

    Any exterior or roof sign the height of which shall not exceed 40 percent of the building height above the roof line, but not to exceed 20 feet above the roof line in any case. For buildings less than 40 feet in height, the maximum height above the roof line for any exterior or roof sign shall be 16 feet.

    (3)

    Height regulations. No principal building shall exceed four stories or 50 feet in height, whichever is less, except as otherwise provided in section 109-20. No accessory structure shall exceed one story or 18 feet in height, whichever is less.

    (4)

    Lot area, lot frontage, and yard requirements. The following minimum requirements shall be observed, subject to the modified requirements contained in section 109-20:

    Principal permitted uses None required unless fronting on the proposed right-of-way of thoroughfare shown on the official major street plan; in which case the building setback line shall be the proposed right-of-way line.     Multifamily dwellings Same as specified in the R-3 district.
    Hotels and motels Same as specified in the C-2 district.
    Accessory uses Same as principal use.

     

    (5)

    Maintaining attractive appearance of the central business district:

    a.

    Property owners in the central business district will construct and/or maintain their buildings and grounds to enhance the appearance of the central business district.

    b.

    Building frontages should be constructed of or faced with brick, stone, stucco, paned glass, or glass block. With a fireproof construction underneath, frontages may also be faced with stained or painted wood siding.

    c.

    The use of blown, foam, or other soft edging around windows, door, or the bases of building is prohibited.

    d.

    Side yards should be blocked off with walls or fencing flush with the building frontage.

    e.

    The images or words on signs shall be in good taste, in keeping with a family-oriented business district.

    f.

    No trees, shrubbery, or other plants shall be planted on city-owned property in front of the structure without prior council approval; this area shall be maintained as a walkway.

    g.

    Designs for a new or outwardly remodeled buildings will be presented to the planning and zoning commission for approval and will include:

    1.

    To scale drawing of the building, with measurements;

    2.

    An indication of the building materials to be used, labeled in detail on the drawing;

    3.

    The content of any signs, a separate drawing of the sign;

    4.

    Indication of any landscaping plans;

    5.

    Indication of any exterior lighting plans.

    h.

    The planning and zoning commission may require changes in the construction or remodeling plans before approval is given.

    i.

    Construction may not begin until the city council has also given its approval.

    (6)

    Business signs:

    a.

    In the central business district, signs, any part of which project out from the building from four to 18 inches shall be erected so that no portion of the sign is less than ten feet above grade.

    b.

    Signs which project more than 18 inches from the building must be at least 12 feet above grade and may extend a maximum height of eight feet provided that they do not extend further than a point two feet in back of the curb face.

    c.

    Signs, canopies, or awnings should be structurally stable and securely fastened to the building. Signs, canopies, or awnings should not obstruct the view of motorists or pedestrians.

    d.

    The council is authorized to have any sign, canopy, or awning inspected and to notify owners of changes or repairs needed in order to comply with this order.

    e.

    Any violation of this chapter not remedied within 30 days of council notification shall result in the removal of the non-complying sign, canopy, or awning.
