§ 28-456. Prohibited practices.

  • It shall be unlawful for any person to:

    (1)

    Unlawful use of containers. Deposit refuse in any solid waste containers other than the person's own without the written consent of the owner of such containers.

    (2)

    Unlawful tampering with containers. Deposit, remove, deface, destroy, disturb or tamper with waste storage containers. This section shall not apply to the owner, occupant or members of their family, the owner's agent, or the city with respect to the owner's solid waste storage containers.

    (3)

    Interfere with collectors. Interfere in any manner with solid waste collection equipment or with solid waste collectors in the lawful performance of their duties, whether such equipment or collectors be those of the city or those of any other authorized waste collection service.

    (4)

    Unlawful disposal. Dispose of solid waste at any facility or location which is not an approved disposal site.

    (5)

    Unlawful collection. Collect or pickup, or cause to be collected or picked up, or engage in the business of collecting, transporting, processing, or disposing of solid waste within the city without authorization by the council. Any and each collection in violation of this provision from one or more locations shall constitute a separate and distinct offense punishable as a violation of this article.

    (6)

    Incinerators prohibited. Use, or sell or offer for sale, or install or offer to install any device intended for use as a solid waste burner or incinerator; except when the intended user of such a device has secured permission to operate or use such device from the state department of natural resources and the city or where the device will be operated by or for the city.

    (7)

    Unlawful placement of refuse.

    a.

    Sweep or deposit any refuse or litter in any public place or public way except in a solid waste container provided for such purposes. Persons owning or occupying property shall keep the sidewalk and any right-of-way bordering their property free of litter.

    b.

    Deposit any residential refuse in any public place or public solid waste container.

    c.

    Place or maintain paper, litter, excelsior, garbage, trash or rubbish of any kind whatever in open deposits on the ground or in open containers which do not meet the requirements of this article.

    d.

    Place or maintain garbage, rubbish, recyclables or trash or other solid waste for curbside collection in violation of this article.

    e.

    Place or deposit residential refuse in any commercial container without the written permission of the person responsible for the commercial container.

    (8)

    Littering. Discard any litter on or in any water or land, except when and where authorized. When litter is discarded from a motor vehicle, the driver of the motor vehicle shall be responsible for the act in any case where doubt exists as to which occupant of the motor vehicle actually discarded the litter.

    (9)

    Open dumping. Dump or deposit, or permit the dumping or depositing of, any solid waste except rubble at any place other than an approved disposal site.

    (10)

    Pollution of water, streets.

    a.

    Throw, place, or deposit, or cause to be deposited, any garbage, refuse, litter, solid waste, manure, carrion, dead animals, offal, putrid, or unwholesome substance, upon the margin, banks or into any stream or water, or upon any street, alley, public way, ditch or public grounds, or upon any property of another within the limits of the city.

    b.

    Allow or permit any litter, solid waste, other offensive substance or noxious matter of any kind to run or fall from or out of any building or vehicle into or upon any street, alley, public way, ditch or public grounds, or upon any property of another within the limits of the city.
