§ 28-453. Waste storage containers.

  • Every person owning, managing, operating, leasing, or renting any premises, dwelling unit, commercial establishment, church, school or any place where solid waste accumulates shall provide, and at all times maintain in good order and repair, portable containers for solid waste. Said containers shall be waterproofed, rat-proof, and fitted with a tight lid. Containers shall have handles, bails or other suitable lifting devices with tapered sides for easy emptying. Oil or grease drums, paint cans, and similar salvaged containers shall not be acceptable. All solid waste shall be sorted as provided in section 28-455, and placed in suitable containers, except it shall not be necessary to place books, boxes, magazines or newspapers in containers provided they are securely tied in bundles or completely contained in disposable boxes not larger than 24 inches by 24 inches by 36 inches or brown paper bags, no bundle or bag of which will weigh more than 50 pounds. Large bulky items such as furniture and appliances that cannot be reduced to fit approved containers must be collected by special pickup. In addition, all containers shall be in accordance with the following:

    Container specification.

    a.

    Residential waste containers shall be made of galvanized metal, rubber, fiberglass, or of plastic which does not become brittle in cold weather. Disposable bags manufactured for solid waste disposal and approved by the city shall be acceptable as long as the bags contain no rips, tears or holes and are securely tied shut. The containers shall have a minimum capacity of not less than 20 gallons and not more than 35 gallons. They shall be of light-weight and sturdy construction, with the total weight of any individual container, fully loaded, not to exceed 75 pounds. They shall be of the type manufactured for storage of residential wastes. They shall be fitted with a fly-tight lid, which shall remain in place except for the deposit or removal of wastes.

    Every person owning, managing, operating, leasing, or renting any commercial establishment, church or school where excessive amount of refuse accumulates and where its storage in portable containers as required above is impractical, shall maintain metal bulk storage containers approved by the city.

    (2)

    Nonconforming containers. Solid waste containers, which are not approved, will be collected and disposed of by the city. The city or its designee shall first notify the owner of any non-approved container by affixing a notice to the container that if the container continues to be used to hold solid waste, it will be collected and disposed of by the city without compensation to the owner.
