§ 28-451. Conditions subject to abatement.

  • If any private disposal operation within the corporate limits of the city is found contrary to provision of this article, the city shall notify the owner of the land upon which such operation is being carried on and the operator thereof to cease operations and give them a reasonable time, not less than ten days, to close down. Said notice shall be in writing and either personally delivered or mailed by ordinary U.S. mail to the last known addresses of the owner and operator. In the event of the failure of such owner or operator or both to cease operations within such time, the city is authorized to seek abatement of such conditions as a public nuisance and to abate such nuisance in the manner authorized by this Code.
