§ 26-267. Special penalty.

  • (a)

    Any person violating the provisions of this division may, in lieu of the scheduled fine or standard penalty provided for violations of this code allow the person's bicycle to be impounded by the city for not less than five days for the first offense, ten days for a second offense and 30 days for a third offense.

    (b)

    Written notification of the impoundment of the bicycle pursuant to this section shall be served on the person committing the violation or the person's parent or guardian if the person is under the age of 18 by ordinary mail, postage pre-paid, addressed to the address stated on the application for license. The notice shall state the section of this traffic code allegedly violated and the time, date, and circumstances of the alleged violation. The notice shall also inform the alleged violator or the parent or guardian that the bicycle will be impounded unless the person files a written request for a hearing before the council within ten days of the service of the notice. Upon a hearing the council may order the bicycle impounded for a period not to exceed 30 days.
