§ 22-19. Designated as parks authority of the city; powers and duties.

  • The city park board as now existing is the board to administer all parks owned or controlled by the city. The board shall have the following powers and duties:

    (1)

    Officers. To meet and elect from its members a president, a secretary, and any other officers as it deems necessary.

    (2)

    Physical plant. To have charge, control and supervision of all parks, except the swimming pool and fairgrounds shall not be city parks, and to direct and control all affairs of the parks subject to the requirements of this article.

    (3)

    Park employees. To employ persons as may be necessary for the proper management of the parks and recommend to the council compensation for any employees; provided, however, that no persons shall be employed before the council establishes their compensation, and provided further that any contracts of employment shall be subject to subsection (9) of this section. The board may discharge employees by a two-thirds vote of the board, subject however, to the provisions of chapter 35C and section 70A.29 of the Code of Iowa (I.C.A. ch. 35C and I.C.A. § 70A.29).

    (4)

    Recommendation of purchases. To recommend to the council the purchase of equipment and supplies for the parks, provided that the council must approve any recommended expenditures prior to any purchases.

    (5)

    Charges for use. To recommend to the council any charges and fees for the use of the parks. The council may approve, modify or disapprove the recommended charges and fees.

    (6)

    Use by non-residents. To authorize the use of park facilities by non-residents of the city or county and to fix charges therefor.

    (7)

    Adopt rules. To adopt rules, not inconsistent with state law, this Code, or other city rules, for the care, use, government and management of the parks and the business of the board. The rules shall become effective after approval by resolution of the council. The rules shall be posted at or near entrances to any park.

    (8)

    Record of proceedings. To keep a record of the board's proceedings.

    (9)

    Contracts. The board is hereby empowered to enter into negotiations on contracts regarding or concerning the parks, provided that the council must approve, modify, or disapprove any contract recommended to it by the board, and provided further that any party to any proposed contract shall be clearly and expressly informed by the board that any proposed contract is not binding upon the city unless and until approved or modified by the council.

    (10)

    Pledging credit or taxing power. The board may not pledge the credit or taxing power of the city.

    (11)

    Annual report. The board shall make a report to the council each December. This report shall contain statements on the condition of the parks, an itemized statement of equipment and supplies purchased and expended and the cost thereof during the year, the number of persons utilizing the parks when such statistics are conveniently obtainable, and any further information as the council may require.
