§ 12-166. Public hearing.

  • In the event that the grantee fails to respond to the notice described in section 12-164 pursuant to the procedures set forth in section 12-165, or in the event that the alleged default is not remedied within 30 days or the date projected pursuant to subsection 12-165(3), the franchising authority shall schedule a public hearing to investigate the default. Such public hearing shall be held at the next regularly scheduled meeting of the franchising authority which is scheduled at a time which is no less than five business days therefrom. The franchising authority shall notify the grantee in writing of the time and place of such meeting and provide the grantee with an opportunity to be heard.
