§ 12-89. Access to open trenches.

The franchising authority agrees to include the grantee in the platting process for any new subdivision. At a minimum, the franchising authority agrees to require as a condition of issuing a permit for open trenching to any utility or developer that
(1)

The utility or developer give the grantee at least ten days' advance written notice of the availability of the open trench; and

(2)

That the utility or developer provide the grantee with reasonable access to the open trench.

Notwithstanding the foregoing, the grantee shall not be required to utilize any open trench.
